Copyright Policy

1427454 Alberta Inc., operating as MOMMENT ("MOMMENT") respects intellectual property rights and expects users of the MOMMENT services to do the same. This Policy describes how we handle claims of copyright infringement in accordance with the notice-and-notice provisions of the Copyright Act (Canada), sections 41.25–41.27.

1. Submitting a Notice of Claimed Infringement

If you believe content on the Services infringes your copyright, send a notice of claimed infringement to legal@momment.io or by mail to our legal office (address below). To comply with the Copyright Act, your notice must be in writing and must:

1. state your name and address, and any other particulars enabling communication with you (such as a telephone number or email address);
2. identify the work or other subject-matter to which the claimed infringement relates;
3. state your interest or right with respect to the copyright in that work;
4. specify the location data for the content in question (for example, the URL or an in-app link to the stream or recording);
5. specify the infringement that is claimed; and
6. specify the date and time of the claimed infringement.

Notices that are incomplete, or that contain offers to settle, demands for payment, or requests for personal information, may not qualify under the Act and may not be processed.

2. What We Do with a Valid Notice

On receipt of a notice that complies with the Copyright Act, we will, as required by the Act:

• forward the notice electronically to the user responsible for the identified content and confirm the forwarding to you (or explain why forwarding was not possible); and
• retain records identifying the user for the period required by the Act.

The notice-and-notice regime does not itself require removal of content. However, independent of that regime, MOMMENT may in its discretion remove or restrict access to content that we determine infringes copyright or violates our Terms of Service, and we routinely do so for clear infringement.

3. Repeat Infringers

We may suspend or terminate the accounts of users who are the subject of repeated credible infringement notices or who we determine have repeatedly infringed copyright.

4. Responsibilities of Uploaders

Users who upload, record, or stream content are responsible for ensuring they hold all rights necessary for that content, including synchronization and performance rights for any music it contains. See the Terms of Service and, for teams, the Producer & Team Agreement.

5. Misuse of this Process

Knowingly submitting false or misleading claims of infringement may expose you to liability. If you are unsure whether use of a work is infringing, consider obtaining legal advice before submitting a notice.
