Privacy Policy
This Privacy Policy describes how 1427454 Alberta Inc., operating as MOMMENT ("MOMMENT," "we," "us") collects, uses, discloses, and protects personal information in connection with the MOMMENT mobile applications, the momment.io website, and related services (the "Services"). We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and the Personal Information Protection Act (Alberta) ("PIPA"), and other applicable Canadian privacy laws.
1. Information We Collect
Account information. Name or display name, email address, authentication identifiers (for example, a sign-in identifier provided by your device platform), and profile details you choose to provide.
Content. Video, audio, images, and text you upload, record, stream, or post, including live streams, recordings, highlights, comments, and reactions. Video content frequently includes images and audio of identifiable people, including minors — see Section 4.
Purchase information. Records of your purchases and subscriptions. In-app payments are processed by the Apple App Store or Google Play; we do not receive your full payment card details from those platforms. Team payouts are processed by Stripe; Stripe collects the banking and identity information required to make payouts, under its own terms and privacy policy.
Usage and device information. App and page interactions, viewing activity, device type, operating system, app version, IP address, approximate location derived from IP address, and diagnostic logs, collected to operate, secure, and improve the Services.
Communications. Messages you send to us, and email delivery information for notices we send you (for example, payout reports sent to a team's designated email address).
2. How We Use Personal Information
We use personal information to: provide and operate the Services (including delivering streams and recordings to entitled viewers); create and manage accounts, teams, and Family Circles; process purchases, entitlements, and team payouts; generate features such as highlight reels from content you or your team create; enforce our Terms of Service and Community Guidelines, including safety review of content involving minors; provide support; send service, billing, and payout communications; maintain security and prevent fraud and abuse; and comply with legal obligations.
We do not sell personal information.
3. Consent
We collect, use, and disclose personal information with consent, except where permitted or required by law. By creating an account and using the Services you consent to the practices described in this Policy. Where you upload or stream content containing other identifiable people, you are responsible for obtaining their consent — see Section 4 for minors. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice; withdrawing consent may limit our ability to provide the Services.
4. Children and Minors
MOMMENT is designed for families and teams, and minors routinely appear in content on the Services. We treat this with heightened care:
- Accounts. Accounts may only be created by individuals who have reached the age of majority in their province or territory. We do not knowingly permit minors to create accounts or make purchases.
- Minors in content. The account holder who records, uploads, or streams content is responsible for obtaining the verifiable consent of each minor's parent or legal guardian to the recording and its distribution through the Services, and, where the content is offered for sale, to its sale.
- Access controls. Family Circle and team visibility settings control who can view content. Content offered for public sale is subject to human safety review before it becomes available.
- Removal requests. A parent or legal guardian may request removal of content depicting their child by contacting legal@momment.io. We will act on verified requests promptly.
5. Disclosure of Personal Information
We disclose personal information only as follows:
- Service providers. To vendors who process information on our behalf to run the Services, including cloud hosting and video infrastructure providers, the Apple App Store and Google Play (purchase processing), Stripe (payout processing), and email and analytics providers. Service providers are permitted to use personal information only to provide services to us.
- Teams and viewers, per your settings. Content and profile information are visible to others according to the visibility settings that apply (for example, within a Family Circle, to a team's supporters, or publicly where content is published publicly). Team funds-raised figures shown on the Services are aggregate amounts and do not identify individual purchasers.
- Legal. Where required or permitted by law, including to comply with a subpoena, warrant, or court order, to protect the safety of any person (including a minor), to enforce our agreements, or to detect and prevent fraud or abuse.
- Business transactions. In connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality protections and applicable law.
6. Where Information Is Stored
Our service providers may store or process personal information outside of Alberta and outside of Canada, including in the United States. While personal information is in another jurisdiction, it is subject to the laws of that jurisdiction and may be accessible to its courts, law enforcement, and national security authorities. By using the Services you acknowledge this transfer, storage, and processing. Questions about our policies and practices regarding foreign service providers may be directed to legal@momment.io.
7. Safeguards
We protect personal information with security measures appropriate to its sensitivity, including encryption in transit, access controls, role-based permissions, and audit logging. No system is perfectly secure; we cannot guarantee absolute security.
8. Retention
We retain personal information only as long as necessary for the purposes described in this Policy or as required by law. Content you delete is removed from the Services, subject to limited retention in backups and to records we must keep (for example, purchase, payout, and consent records) for legal, accounting, and audit purposes.
9. Your Rights
Subject to applicable law, you may request access to your personal information, request correction of inaccurate information, withdraw consent, and request deletion of your account and content. Submit requests to legal@momment.io. We will respond within the time required by PIPA and PIPEDA (generally 45 days under PIPA, extendable as permitted). If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner of Alberta or the Office of the Privacy Commissioner of Canada.
10. Breach Notification
If a breach of security safeguards involving personal information creates a real risk of significant harm, we will notify affected individuals and report to the applicable privacy commissioner(s) as required by PIPA and PIPEDA.
11. Cookies and Similar Technologies
Our website uses cookies and similar technologies for essential functions such as sign-in sessions and security. Where we use analytics technologies, they are configured for measuring and improving the Services. You can control cookies through your browser settings; disabling essential cookies may prevent parts of the Services from working.
12. Changes to this Policy
We may update this Policy by posting a revised version at momment.io/legal with an updated effective date. Material changes will be notified through the Services or by email.
